Wizjoner\u00f3w 5 \/ 51, 31-356 Krak\u00f3w, Poland, NIP: 6772488476, REGON: 524014367, e-mail address: biuro@jaworska-kancelaria.pl<\/span><\/p>\n<h4 style=\"text-align: center;\"><span style=\"font-weight: 400;\">\u00a7 1 Definitions<\/span><\/h4>\n<p><span style=\"font-weight: 400;\">For the purposes of these regulations, the following meanings of the following terms are introduced:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Online store &#8211; the service operating at the Internet address <\/span><a href=\"https:\/\/jaworska-kancelaria.pl\/en\/shop\/consultation\/\"><br \/>\n  <span style=\"font-weight: 400;\">https:\/\/jaworska-kancelaria.pl\/shop\/konsultacja\/<\/span><br \/>\n<\/a><span style=\"font-weight: 400;\"> <\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Consumer &#8211; a natural person making a purchase of a Consultation in the scope not directly related to his\/her business or professional activity (according to the wording of Article 221 of the Civil Code),<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Entrepreneur &#8211;<\/span><span style=\"font-weight: 400;\"><br \/>\n  <br \/>\n<\/span><span style=\"font-weight: 400;\">a natural person, a legal person and an organizational unit that is not a legal person,<\/span><span style=\"font-weight: 400;\"><br \/>\n  <br \/>\n<\/span><span style=\"font-weight: 400;\">to which a separate law grants legal capacity, performing in its own name<\/span><span style=\"font-weight: 400;\"><br \/>\n  <br \/>\n<\/span><span style=\"font-weight: 400;\">business activity, which uses the Store.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Consultation &#8211; a service provided by means, used to communicate at a distance or at the office of the Law Firm, paid by online transfer.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Regulations &#8211; these rules and regulations,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Seller\/Service Provider &#8211; Anna Jaworska, conducting business under the name Kancelaria Prawna Jaworska &amp; Wsp\u00f3lnicy ul. Wizjoner\u00f3w 5 \/ 51, 31-356 Krak\u00f3w, Poland, NIP: 6772488476, REGON: 524014367<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Customer &#8211; a natural person with full legal capacity, a legal person or an organizational unit without legal personality who purchases products.<\/span><\/li>\n<\/ul>\n<h4 style=\"text-align: center;\"><span style=\"font-weight: 400;\">\u00a7 2 Purchase of Consultation<\/span><\/h4>\n<ol>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The cost of legal advice is according to the price list posted on the advice booking form page: <\/span><a href=\"https:\/\/jaworska-kancelaria.pl\/en\/shop\/consultation\/\"><br \/>\n  <span style=\"font-weight: 400;\">https:\/\/jaworska-kancelaria.pl\/shop\/konsultacja\/<\/span><br \/>\n<\/a><span style=\"font-weight: 400;\"> <\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The timing of the service is determined by phone or previous e-mail, after the purchase of the Consultation.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The service provider establishes by e-mail with the client the need to send documents, details necessary for the service and the deadline for sending them.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The customer must make a purchase, by filling out the order form and approving it through the Buy and Pay option.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">Possible forms of payment are traditional transfer, online transfer, BLIK<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The customer is presumed to be a natural person. In a situation where in the order form, the company&#8217;s data is given, it is presumed that.<\/span><\/li>\n<\/ol>\n<p><span style=\"font-weight: 400;\">The Customer is an entrepreneur and the Service is provided directly in connection with the Customer&#8217;s business or professional activity.<\/span><\/p>\n<h4 style=\"text-align: center;\"><span style=\"font-weight: 400;\">\u00a7 3 Scope of Consultation  <\/span><\/h4>\n<p><span style=\"font-weight: 400;\">1.The scope of the prepared Advice is determined by the facts presented by the Client.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">(2) The Customer may not rely on the incompleteness, unsuitability of the content of the Advice or the damage suffered as a result of the use of the Service if it has not comprehensively presented the facts.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">(3) The service provider will be available and will answer additional questions from the customer within 24 hours of sending the first opinion content. These responses do not involve additional compensation to the Service Provider.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">(4) Submitting new questions that were not covered by the facts or submitting them after the deadline specified in paragraph 3 shall result in the Service Provider having to determine again the additional price of the Service.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">(5) The service is provided during the working hours of the Office, unless other individual arrangements have been made.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">The Client declares that he is aware of the fact that in the Polish legal order there is no binding interpretation of the law (therefore, any interpretation of a legal act is not absolute and deviations from it are possible). The customer declares that he is aware that in practice he may encounter a different position and interpretation of the same factual situation.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">(7) An individual consultation shall include the Service Provider&#8217;s individual interpretation of a given state of facts. The Service Provider may inform the Client about discrepancies in doctrine, jurisprudence, practice, as to the interpretation of regulations, relating to the presented facts, practice and jurisprudence as to the interpretation of legal regulations, presenting its own view on this background, with the proviso that it is possible to meet in theory, as well as in practice, with a different view. Such preparation of the Advice cannot be the basis of a complaint.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">(8) The Client declares that he is aware that in tax and social security matters, in order to gain certainty of the correctness of the solution, he should apply for an individual interpretation to the competent tax authority<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">9.The service provider does not guarantee an effective solution to the problem, presented in the facts, such as would be in accordance with the wishes of the Client. As far as possible, the Service Provider will propose various solutions to the indicated problem and indicate the one that, in its opinion, may be the most beneficial or effective.<\/span><\/p>\n<h4 style=\"text-align: center;\"><span style=\"font-weight: 400;\">\u00a7 4 Withdrawal from the contract<\/span><\/h4>\n<ol>\n<li><span style=\"font-weight: 400;\">  The user who is a Consumer has the right to withdraw from the contract concluded with the Seller within 14 days from the date of conclusion of the contract. To exercise your right of withdrawal, you must inform the Seller of your decision to withdraw from the contract by an unequivocal statement (for example, a letter sent by mail or e-mail). In order to comply with the withdrawal period, it is sufficient for the User to send information on the exercise of his\/her right of withdrawal before the expiry of the withdrawal period.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">(2) With regard to Individual Legal Consultation: The right to withdraw from the Contract is not granted to the Consumer if the Service Provider has fully performed the service (i.e. sent the content of the Consultation to the Consumer, communicated with the Consumer through devices, used for remote communication). The Service Provider hereby informs the Consumer that after the Service Provider&#8217;s performance, the Consumer will lose the right to withdraw from the contract, and the Consumer agrees that the Service Provider will perform the service in full before the expiration of the 14-day withdrawal period under Art. 38(1) of the Consumer Rights Law.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">3 According to Art. 35 para. 1 of the Law on Consumer Rights A consumer who withdraws from the Agreement before the content of the Consultation is sent to him or realized through devices, used for remote communication, is obliged to pay for the services provided by the Service Provider until the withdrawal from the Agreement. In particular, this applies to factual analysis, document analysis, case law, made by the Service Provider. The amount of payment shall be calculated in proportion to the extent of the service provided, taking into account the remuneration.<\/span><\/li>\n<\/ol>\n<h4 style=\"text-align: center;\"><span style=\"font-weight: 400;\">\u00a7 5 Complaints<\/span><\/h4>\n<ol>\n<li><span style=\"font-weight: 400;\">  The Seller is obliged to provide the content of the Consultation free of defects.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">(2) The user may file complaints about the purchased products or the purchasing process itself.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">(3) The complaint should be sent to the e-mail address of the Seller, i.e.. biuro@jaworska-kancelaria.pl<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">(4) The complaint should contain data that allows identification of the User, the subject of the complaint and the demands related to the complaint. In the case of receipt of an incomplete complaint, the Seller will call on the User to complete it under pain of leaving the complaint unprocessed.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">(5) The Seller will respond to a complete complaint within 14 days from the date of delivery of this complaint to the Service Provider. The response will be sent to the e-mail address that was used to make the complaint.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">(6) The service provider shall not accept the complaint if:<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">&#8211; made clear in the Consultation that there are discrepancies in the interpretation of the regulations and that they can be applied differently;<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">&#8211; in the Consultation indicated that it is necessary to apply for individual interpretations to the relevant authorities, e.g., tax authorities;<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">advice is unfavorable to the client, but in accordance with current legislation, practice and case law,<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">&#8211; Another lawyer gave a different opinion on the same subject.<\/span><\/li>\n<\/ol>\n<h4 style=\"text-align: center;\"><span style=\"font-weight: 400;\">\u00a7 6 Personal data and cookies<\/span><\/h4>\n<p><span style=\"font-weight: 400;\">The rules for the processing of personal data and the use of cookies are described in the privacy policy available at <\/span><a href=\"https:\/\/jaworska-kancelaria.pl\/en\/\"><br \/>\n  <span style=\"font-weight: 400;\">https:\/\/jaworska-kancelaria.pl\/<\/span><br \/>\n<\/a><span style=\"font-weight: 400;\"> <\/span><\/p>\n<h4 style=\"text-align: center;\"><span style=\"font-weight: 400;\">\u00a7 7 Out-of-court ways of dealing with complaints and claim investigation<\/span><\/h4>\n<ol>\n<li><span style=\"font-weight: 400;\">  The vendor agrees to submit any disputes arising in connection with the contract of sale and\/or delivery of digital content in the form of a product or individual consultation selected by the user to mediation proceedings. Details will be determined by the conflicting parties.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">(2) The user who is a Consumer shall have the opportunity to use out-of-court means of handling complaints and claims. A consumer, he has the option:<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">&#8211; to apply to a permanent amicable consumer court with a request to resolve a dispute arising from the contract,<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">&#8211; apply to the provincial inspector of the Trade Inspection with a request to initiate mediation proceedings for an amicable settlement of the dispute between the User and the Seller<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">&#8211; use the assistance of a district (city) consumer ombudsman or a social organization whose statutory tasks include consumer protection.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">(3) For more detailed information on out-of-court complaint and redress procedures, the User can look for at http:\/\/www.uokik.gov.pl.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">(4) The consumer can also use the ODR platform, which is available at <\/span><a href=\"http:\/\/ec.europa.eu\/consumers\/odr\"><br \/>\n  <span style=\"font-weight: 400;\">http:\/\/ec.europa.eu\/consumers\/odr<\/span><br \/>\n<\/a><span style=\"font-weight: 400;\">. The platform serves to resolve disputes between consumers and businesses seeking out-of-court settlement of disputes regarding contractual obligations arising from an online sales contract or service contract.<\/span><\/li>\n<\/ol>\n<h4 style=\"text-align: center;\"><span style=\"font-weight: 400;\">\u00a7 8 Amendments to the Regulations<\/span><\/h4>\n<ol>\n<li><span style=\"font-weight: 400;\">  In the case of Customers who are also Consumers, the provisions of the Regulations do not prejudice their protection.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">(2) The Service Provider reserves the right to make changes to the Terms and Conditions, which shall come into force on the date of their publication at <\/span><a href=\"https:\/\/jaworska-kancelaria.pl\/en\/\"><br \/>\n  <span style=\"font-weight: 400;\">https:\/\/jaworska-kancelaria.pl\/<\/span><br \/>\n<\/a> <span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">(3) The version of the Terms and Conditions in effect on the date the User enters into an Agreement with the Seller shall apply to Agreements entered into before the amendment of the Terms and Conditions.<\/span><\/li>\n<\/ol>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t","protected":false},"excerpt":{"rendered":"<p>Before making a purchase in the online store, each customer is obliged to read the contents of these terms and conditions of sale.
