Divorce begins with the drafting and filing of a petition for divorce. The lawsuit must be in writing, meet formal requirements and contain information on the basis of which the court will be able to declare the complete and permanent dissolution of marriage. The divorce petition should not lack the following information: indication that it is a divorce petition; designation of the court to which the letter is addressed; precise identification of both parties to the divorce proceedings, which means that the names and addresses of the plaintiff and the defendant must be given (the plaintiff, i.e. the person who files the petition, must additionally give his or her PESEL number); clearly specified demands, i.e. you must specify whether you are filing for divorce with or without a declaration of guilt; additional demands, concerning custody of the children, alimony or use of the common dwelling; information on whether mediation was attempted or an explanation of why it was not done; justification, that is, arguments and evidence confirming the complete and permanent breakdown of marital relations.<\/p>\n","protected":false},"excerpt":{"rendered":"
