According to Art. 491 of the Bankruptcy Law if the assets and income of the insolvent debtor do not allow to cover the costs of the proceedings, the Treasury shall cover them temporarily. However, the debtor should return them under a debt repayment plan. Such reimbursement can be postponed until the debtor’s financial situation improves, such as when he finds employment. If, on the other hand, there is no chance to do so (for example, due to serious illness), the costs of the proceedings can be waived entirely.The waiver of bankruptcy costs often occurs in the case of pensioners who have no assets and, in addition, receive low Social Security benefits.
