The extent of alimony payments depends on the legitimate needs of the entitled person and the earning and asset capacity of the obligor. In alimony cases, the court is required to accurately and thoroughly determine the justified needs of the alimony recipient and the ability of the obligors to meet them. The extent of the child’s legitimate needs should be determined in such a way that, if they are met, the child’s standard of living will be the same as that of the parents. Parents must therefore share even the smallest income with their child. Parents, therefore, depending on their abilities, are obliged to provide the child with the means to meet his physical needs – food, housing, clothing, personal hygiene, medical treatment in case of illness, as well as spiritual (cultural), also the means of education (training). Therefore, it is impossible to set a minimum child support, as it depends on many factors. In practice, however, the minimum child support, which happens most often, is PLN 500 – PLN 600 per child.
