The sum of the costs will consist of court fees and attorney’s fees; remuneration of the court supervisor or administrator; court expenses during the proceedings. You must pay a court fee of PLN 1,000 on the application to open restructuring proceedings. The exception is a simplified application for the opening of sanitation proceedings (one of the types of restructuring), here the fee is PLN 200. The conduct of restructuring proceedings can be outsourced to a legal advisor or attorney. The cost of legal representation will be at least PLN 3,600. The more complicated the case, the higher these costs can be.The cost of simplified restructuring will be significantly lower than other restructuring proceedings. The principal costs are the cost of notices in the MSiG (PLN 500 per notice), the court fee on the application for approval of the arrangement (PLN 1,000) and the remuneration of the restructuring advisor. The legislator’s goal was to limit the statutory maximum remuneration of advisors especially for micro and small entrepreneurs and in case the court refuses to approve the arrangement or the proceedings are discontinued. The regulations therefore assure the debtor that the proceedings will not be expensive, especially if they fail.
