At the time of filing a petition for the division of joint property with the District Court, such proof of payment of the court fee of PLN 1,000 must be submitted as an attachment, while if the petition includes a consensual proposal for the division of this property – the amount of the fixed fee is PLN 300. If the spouses disagree on the value of the property, the cost of the expert’s fees will have to be added to the cost of division. Appointment of an expert appraiser will be necessary in the event of a dispute between spouses over both the value of property included in the joint estate and other assets, such as a car. The cost of preparing one expert opinion can range from 2 to 3 thousand zlotys. The attorney’s fee will depend on the rate individually agreed with the client. Its amount will be determined based on the complexity of the case and the estimated workload. However, it cannot be lower than the minimum rate under the Minister of Justice’s regulation on attorney’s fees.
