The first cost in the process of declaring a company bankrupt is a court fee of PLN 1,000 on the company’s bankruptcy petition. This fee must be paid to the bankruptcy court’s account even before the bankruptcy petition is filed, and proof of the transfer is attached to the bankruptcy petition itself. The bankruptcy petition must also be accompanied by proof of payment of an advance for the expenses of the proceedings in the amount of approx. PLN 5,148.07. The amount changes each year and is set as one times the average monthly salary in the enterprise sector excluding profit-sharing in the third quarter of the previous year, as announced by the President of the Central Statistical Office. The costs of a proper bankruptcy proceeding should be paid from the bankruptcy estate, i.e., the debtor’s assets to be carried out to carry out the bankruptcy. These costs will include, among others, the costs associated with the sale of the bankrupt’s assets, or the costs associated with establishing a list of creditors and their claims against the bankrupt. Their amount will depend on a number of circumstances – what assets and their value are included in the bankruptcy estate, how many of the bankrupt’s creditors there are, and other individual factors. The trustee’s fee is also a key expense. The amount of this remuneration is determined by the Court, taking into account the amount of funds of the bankruptcy estate, the degree of satisfaction of creditors, the workload of the trustee, the scope of activities undertaken in the proceedings, their degree of difficulty and the duration of the proceedings. Other costs associated with the bankruptcy proceedings must also be added to these costs. These will include the cost of advertisements in the Court and Commercial Gazette, the cost of people employed by the trustee (e.g., an accountant), the cost of using the necessary premises, the cost of correspondence, the cost of filing documents, the cost of creditor services, taxes and other public fees.
